FAQ
Do I get 15 days if I leave after exactly one year?
Annual leave arises the day after you complete a year. If you leave after exactly 365 days you keep only the first-year monthly leave (up to 11 days), according to the Supreme Court (2021Da227100) and the Ministry of Employment and Labor. Your employment must continue at least one more day.
Does annual leave apply at small companies?
Statutory annual leave applies to workplaces with 5 or more regular employees. Smaller employers may still grant leave through work rules or your contract.
Can I get paid for unused leave?
Leave expires one year after it arises, but unless your employer formally encouraged you to use it, unused days must be paid (daily ordinary wage × days). Unused leave is also paid out when you leave.
